Welcome to ShutterUp Photography! These Terms & Conditions ("Terms") govern your use of https://shutterupphotographer.com (the "Website") and any services provided by ShutterUp Photography ("we," "us," "our"). By booking a session or using this Website, you agree to these Terms.

1. Services & Bookings
A. Booking Process
Clients must submit an inquiry through our contact form or booking system.
A signed contract and a non-refundable retainer (deposit) are required to secure your date.
Dates are not held until both the contract and retainer are received.
B. Payment & Fees
Full payment is due by the agreed-upon date in the contract.
Accepted payment methods: PayPal, HoneyBook, Tave, Venmo, Zelle, ApplePay.
Late payments may incur additional fees.

2. Cancellation & Rescheduling
A. Client Cancellations
Retainers are non-refundable. If you need to cancel, no refunds will be issued.
Rescheduling is allowed for emergencies, subject to availability. A rescheduling fee may apply.
B. Photographer Cancellations
If we must cancel due to illness, emergency, or unforeseen circumstances, we will offer a full refund or reschedule the session.

3. Copyright & Image Usage
A. Ownership
ShutterUp Photography retains full copyright ownership of all images.
Clients receive personal use rights but may not sell, edit, or alter the images in any way.
B. Social Media & Portfolio Use
We reserve the right to use images for marketing, portfolio, social media, and promotional materials.
If you wish to keep your photos private, please notify us before the session in writing.

4. Client Responsibilities
Clients must arrive on time for sessions. Late arrivals may result in reduced session time without refund.
Clients are responsible for obtaining location permits (if applicable).
We are not responsible for weather conditions but offer rescheduling options in case of extreme weather.

5. Editing & Image Delivery
Standard editing includes color correction, light retouching, and exposure adjustments.
Additional retouching requests (skin smoothing, object removal, extensive edits) may incur extra fees.
Images are delivered via an online gallery within the timeframe specified in your contract.

6. Liability & Force Majeure
ShutterUp Photography is not responsible for lost or damaged photos due to equipment failure, accidents, or unforeseen circumstances.
If an event beyond our control (natural disaster, pandemic, emergency) prevents the session, we will work to reschedule or refund.

7. Refunds & Satisfaction Policy
Due to the nature of photography services, all sales are final. No refunds will be given once a session has been completed.
If there are technical issues with the final images, we will work to correct them.

8. Third-Party Vendors
If we recommend vendors (makeup artists, florists, venues, etc.), we are not liable for their services.
Clients should communicate directly with vendors regarding their agreements.

9. Privacy Policy
Your personal information is protected under our Privacy Policy. We do not share or sell client data.
By booking, you agree to receive occasional emails with updates, promotions, or important session details. You can opt out at any time.

10. Governing Law & Disputes
These Terms are governed by the laws of Texas.
Any disputes will first be resolved through mediation. If further action is needed, it will be handled in Brazoria, Texas courts.

11. Changes to These Terms
We reserve the right to update these Terms at any time. The latest version will always be available on our Website.
